Livdat User Agreement
Livdat strives to maintain a fun, healthy, and safe community for all our users. In order to preserve our mission, we have developed a set of community guidelines (“Guidelines”), which we take very seriously. We have a zero-tolerance policy, and we have the right, in our sole discretion, to remove any content (“Content” as defined set forth below) and/or suspend or terminate any offending user account if we find that any of the following violations of our Guidelines has occurred:
“Content” includes anything that can be seen, heard and/or referenced in any broadcast or broadcast title, any text or images posted to any Comments section, and any information posted or contained in any profile in connection with Livdat .
Please read the following carefully and assess your activity and adherence accordingly:
（1）Livdat users refer to the registered users of Livdat , and their behavior is subject to this Guidelines. The behavior of unregistered users on Livdat should also be bound by this Guidelines.
（2）Livdat users must act in accordance with all applicable local, national, and inteational laws on Livdat . Any content or activities that violate the law or instigate others to carry out illegal activities are prohibited.
（3）Livdat only provides live broadcasting service, and any additional commercial activities derived from other platforms are independent behaviors.
1. No Nudity or Overly Sexualized Content.
Livdat expressly forbids our broadcasters from engaging in, or broadcasting any of the following sex-related Content that promotes sexual activity, exploitation and/or assault. Sexually implied content or activities are also prohibited, although additional content may be permitted for educational content or pre-approved, but in each case additional restrictions must be observed. We reserve the right to report misuse of inappropriate content to relevant law enforcement agencies, including but not limited to:
2. No Bullying, Harassment, or Hateful Language or Symbols.
Regardless of whether the target is on Livdat , we prohibit the use of Livdat for all bullying, harassment and hate speech. We do not allow individuals, communities or organizations that perform such behavior to use our services. The type of this content, including but not limited to the following:
3. No one Under the Age 18 is Allowed to Stream on Livdat
In the interests of child safety, Livdat does not currently allow anyone under the age of 18 to broadcast on the platform.
4. No Use of, or Reference To, Illegal Substances or Criminal Activity.
Content in connection with the use, mention or display of illicit drugs and/or drug paraphealia is strictly prohibited. Content highlighting tobacco and/or alcohol consumption by users is also strongly discouraged on Livdat . Use good judgment, as we reserve the right to punish the account and work with law enforcement when we believe there is a legitimate risk of physical harm or direct threat to public safety, including but not limited to the following (includes marijuana):
4. No Violent, Self-Harming, or Self-Mutilating Acts or Threats.
Livdat has zero tolerance for attempts or threats to harm or kill others. You are ultimately responsible for your own physical and psychological health and well-being, but as a community, we must be respectful of others who may be disturbed or offended by your Content or message. Therefore, we strictly prohibit the following behaviors, including but not limited to:
5. No Posting of Private Content.
Livdat respects the privacy of others, and we work hard to ensure that the information you share with us is secure. Determinations of unauthorized private Content will be determined on a case-by-case basis by Livdat in our sole discretion. Please do the same and refrain from the use of Content which invades another person’s privacy or which divulges their private or confidential information. Examples of private information may include, but not limited to the following:

Livdat prohibits users from making commercial profit through our platform. Please do not use misleading or incorrect information, and please avoid the following behaviors, including but not limited to:
In addition, if you receive advertising from other users in the Livdat community, please report to us at [email protected] .com and avoid clicking or visiting any suspicious looking links/ websites. It is important to understand that we will not be responsible for any consumer actions you make to other users.
7. No Impersonation.
Users are not allowed to impersonate other individuals (whether famous or not) or other Livdat users with the intent to mislead, confuse, or deceive others. When choosing a useame, keep the following in mind:
8. No Violation of Copyrights; DMCA Policy.
Livdat respects the intellectual property rights of others, and we expect that our community of users will do the same. If you share content on Livdat that is not yours or that you do not have the right to share on Livdat , you may have infringed on the intellectual property rights of others. Infringement includes the use of any third-party content in your content, derivative creation, or use of other people's copyright content to perform. We recommend that you evaluate whether your content complies with applicable intellectual property laws and principles that should be appropriately applied, such as the fair use principles. Any unauthorized content you share on Livdat may be subject to removal by the rights owner from Livdat , which violates our Terms of Service and Community Guidelines. Multiple violations may result in a permanent suspension of your account. If you are a copyright owner or a copyright owner’s agent and believe that any Content infringes upon your copyrights, please report it to us immediately. In order to facilitate our investigation, please submit the following information at the same time:
9. Quality Streaming
Users are encouraged to have a well-lit environment for streaming broadcasts and to strive for quality wherever possible.
10. Reporting Abuse.
Because Livdat is a community, we rely heavily on all of your support and we welcome you to report any content or activity that you believe may be in violation of our Guidelines at [email protected] We take your reports very seriously, and in most cases, will ask you for information, please understand and follow the following specifications:
General terms and conditions
These Guidelines constitute the entire agreement between you and Livdat with respect to the subject matter hereof, and supersedes all previous or contemporaneous all written or oral agreements, written and verbal statements, proposals, negotiations and communication, between the parties with respect to the subject matter herein. Livdat may assign these Guidelines or any of the rights or obligations hereunder, and any causes of action arising hereunder, to any third party without necessity or obligation of notice to you. The waiver or failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further right hereunder. The invalidity or unenforceability of any provision of these Guidelines will not affect the validity or enforceability of any other provision, the remaining provisions being deemed to continue in full force and effect. Livdat will not be responsible for any failure to perform its obligations under these Guidelines due to circumstances beyond its reasonable control, including without limitation acts of god, war, riot, terrorism, embargoes, acts of civil or military authorities, fire, flood or other incident of “ Force Majeure”. You agree that Livdat will be entitled to all legal and equitable remedies otherwise available to it to protect the intellectual property, proprietary rights and confidential information of itself and its licensors, including, without limitation, the right to seek and obtain injunctive relief and enforce the same against you without the necessity of having to post bond or other such guarantee. Livdat may change our Community Guidelines at any time, and we will post them on this page when we modify them, so please check them regularly. We may provide additional forms of modification or update notice where appropriate. If you do not agree to any changes to these Guidelines, your only solution is to immediately stop using all applications, services and websites. By posting any changes to these Guidelines and continuing to use any application, service or website, you are accepting the revised guidelines.

Welcome to the Livdat Safety Advocate Program! Your participation means the most to us, and we are looking forward to working together to improve the quality of our broadcasting community for all.
Your privileges as a Safety Advocate will allow any reports you make to be given priority for our moderators, ensuring action will be taken as soon as possible.
Below you will find a few guidelines to help get you started, so you know what to look for and how to respond.
The most common conce in the community pertains to harassment and bullying. Below are some pointers on what to look for:
Our team actively monitors for violence, threats, and harmful objects. Here is a guideline for what that may look like:
Self harm and Suicide are serious issues, and ones that need to be addressed as soon as they are identified. Often times a broadcaster may show signs of potential self harm long before they act on it. Knowing what to look for can be a tremendous help. If you see any of the following, please report the broadcast immediately.
For the safety of the broadcaster, our moderators are trained to not immediately shut down a broadcast if self-harm is of conce, but that does not mean we are not actively monitoring the situation.
Nudity and sexual content are strictly prohibited on Livdat . If you identify nudity or sexually explicit content, please report immediately.
ADVOCATE’S GOLDEN RULE: “When in doubt, call it out.”
If you are uncertain if something is a violation, it’s best to report it and our moderation team will determine if it is in fact a violation. We gladly err on the side of safety.
SAFETY ADVOCATE RESPONSIBLE USE: Being a Safety Advocate is a privilege, and that privilege will be revoked if we find you violating community guidelines, or maliciously reporting individuals. With great power comes great responsibility. We trust that you will act with integrity and purpose.
We want to maintain Livdat as a fun and safe place for all our users. Therefore, please take a moment to read our community rules below. Users who violate these rules will be banished from Livdat.
Please make sure to enter the correct age and gender for your profile. Livdat uses its unique algorithm to match you to another user whom we think both of you will have an excellent time matching. By lying about your age and gender, it will bring an unfortunate and unpleasant Livdat experience for others. If discovered, our system has the right to correct the information for you automatically. Please help report users that appear to have the incorrect information for our team to review. Users under the age of 18 are not allowed on our platform.
Please use appropriate and non-offensive photos that do not contain violence, nudity, or offensive/discriminating imagery. If found to be inappropriate, we will remove your picture immediately to protect other users in the Livdat community.
Livdat has a zero-tolerance policy when it comes to cyberbullying. Cyberbullying includes, but is not limited to, any action is taken to offend another user through the use of inappropriate behavior, nudity, violence, profanity, racism, sexism, threats, illegal activities, and so on. Any users engaging in such behavior will be banned for eteity on Livdat, no questions asked. Be waed, any actions that need to be forwarded to the authorities will be reported immediately.
We have a very strict visual auto-detection AI recognition algorithm set up 24/7 trying to contain these beasts. However, they are quite fickle, and we sometimes miss one or two. Please help us make Livdat, an awesome community by reporting any user that may be conducting cyberbullying. You can use the report button on the upper right of the video chat screen and the user profile screen. Once reported, the user is blocked from harassing you forever, and will be reviewed by our team immediately.
Please don’t take screenshots or videos of other users without their consent. We’re sure that you wouldn’t want the same to happen to you. If for any reason a user’s privacy rights have been violated, the violator may be punished to the full extent of the law.
Please note that there is an age restriction on Livdat. Users under the age of 18 cannot create an account with Livdat and are not allowed on the platform. Please respect our community rules and help us monitor/report any underage users. Livdat has the right to ban and delete any young user accounts.
2. Services Content
2.1.We reserve the right to change the content of our Services from time to time, at our discretion, with or without notice.
2.2 Some of the Services provided by LIVDAT require payment. For paid-for Services, LIVDAT will give you explicit notice in advance and you may only access such Services if you agree to and pay the relevant charges. If you choose to decline to pay the relevant charges, LIVDAT shall not be bound to provide such paid-for Services to you.
2.3 LIVDAT needs to perform scheduled or unscheduled repairs and maintenance. If such situations cause an interruption of paid-for Services for a reasonable duration, LIVDAT shall not bear any liability to you and/or to any third parties. However, LIVDAT shall provide notice to you as soon as possible.
2.4 LIVDAT has the right to suspend, terminate or restrict provision of the Services under this Agreement at any time and is not obligated to bear any liability to you or any third party, if any of the following events occur:
2.4.1 You are under the minimum age in order to receive LIVDAT services;
2.4.3 You fail to make a payment for using paid-for Services.
2.5 EXCEPT FOR THE EXPRESS REPRESENTATIONS AND WARRANTIES SET FORTH IN THIS AGREEMENT, LIVDAT MAKES NO WARRANTY IN CONNECTION WITH THE SUBJECT MATTER OF THIS AGREEMENT AND LIVDAT HEREBY DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER STATUTORY, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND ANY IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR PERFORMANCE, REGARDING SUCH SUBJECT MATTER.
4.1 You are responsible for the accuracy of information that you provide to LIVDAT , and upon request from LIVDAT , verify accuracy of the information given.
4.2 You may not create LIVDAT account for others, or allow others to use your LIVDAT account. You shall immediately notify LIVDAT if you discover unlawful use of your account by others.
4.3 In consideration for our Services, you agree that LIVDAT has the right to place advertisement or other types of commercial information. You also agree to receive advertisement or other relevant commercial information from LIVDAT via email or other methods.
4.4 While using LIVDAT Services, you must abide by all applicable laws and regulations, and all rules and policies of LIVDAT .
4.5 You may only share information that you are comfortable sharing with the public. You may not distribute via LIVDAT any content that may be considered:
4.5.1 poographic, obscene or indecent, or any adult content, including any form of child exploitation;
4.5.2 excessively violent, including any content that is related to death or serious injury;
4.5.3 depicting, encouraging or assisting suicide or self-harm;
4.5.4 rumor, false or misleading information;
4.5.5 hateful speech or conduct, including any content that promote racism, terrorism, ageism or sexism;
4.5.6 profane, blasphemous or any content that may offend people of certain faith, or otherwise related to religion;
4.5.7 related to gambling, abortion, weapon, or other highly explosive subject matter;
4.5.8 abusive, libelous, or otherwise harassing other people or group;
4.5.9 spam, junk mail or other unsolicited advertisement;
4.5.10 other contents that in the judgement of LIVDAT that are negative contents or otherwise not suitable for distribution.
4.6 You may not impersonate any other individual, entity, govemental agency or organizations.
4.7 You may not publish or distribute other people's private information without their express authorization and permission.
4.8 You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish or distribute any copyrighted or proprietary works. You are solely responsible to clear such licenses, rights, consents, and permissions.
4.9 You may not publish or link to any malicious code, phishing website or other content that may threaten the security of the Inteet.
4.11 If LIVDAT discovers or reasonably suspects that any of your virtual gift is acquired in a fraudulent or illegal manner, or is in an abnormal status, LIVDAT may freeze, suspend, disable, ban or revoke such virtual gift.
4.12 If your account is frozen, suspended, disabled, banned or revoked, you may not create a second account or ask any other to create a second account for you.
5. Refund Policy
5.1 Unless otherwise required by the applicable law, no refund will be entertained after the virtual items (such as “diamonds”) has been purchased.
6. Intellectual Property Rights
6.1 All text, data, images, graphics, audio and/or video information and other materials within the Services provided by LIVDAT are property of LIVDAT are protected by copyright, trademark and/or other property rights laws. Nothing in this Agreement shall be construed as conferring any license of any intellectual property rights or such materials by LIVDAT to you.
6.2 By using and/or uploading any live stream content or other content through a LIVDAT Services to publicly accessible areas of LIVDAT website, you grant to LIVDAT and its sub-licensees the permission, free, permanent, irrevocable, non-exclusive and fully sub-licensable rights and license, without any territorial or time limitations and without requiring any approvals and/or compensations, to use, copy, modify, adapt, publish, translate, edit, dispose, create derivate works of, distribute, perform and publicly display such content (in whole or in part), and/or incorporate such content into existing or future forms of work, media or technology.
7. Terminating Services
7.1 You may terminate LIVDAT Services and this Agreement by revoking your LIVDAT account. You may contact us at: [email protected]
8.1 You shall be fully responsible for any risks involved in using LIVDAT Services. Any use or reliance on LIVDAT Services will be at your own risk.
8.2 Under no circumstance does LIVDAT guarantee that the Services will satisfy your requirements, or guarantee that the Services will be uninterrupted. The timeliness, security and accuracy of the Services are also not guaranteed. You acknowledge and agree that the Services is provided by LIVDAT on an “as is” basis. LIVDAT make no representations or warranties of any kind express or implied as to the operation and the providing of such Services or any part thereof. LIVDAT shall not be liable in any way for the quality, timeliness, accuracy or completeness of the Services and shall not be responsible for any consequences which may arise from your use of such Services.
8.3 LIVDAT does not guarantee the accuracy and integrity of any exteal links that may be accessible by using the Services and/or any exteal links that have been placed for the convenience of you. LIVDAT shall not be responsible for the content of any linked site or any link contained in a linked site, and LIVDAT shall not be held responsible or liable, directly or indirectly, for any loss or damage in connection with the use of the Services by you. Moreover, LIVDAT shall not bear any responsibility for the content of any webpage that you are directed via an exteal link that is not under the control of LIVDAT .
8.4 LIVDAT shall not bear any liability for the interruption of or other inadequacies in the Services caused by circumstances of force majeure, or that are otherwise beyond the control of LIVDAT . However, as far as possible, LIVDAT shall reasonably attempt to minimize the resulting losses of and impact upon you.
9. Legal Jurisdiction
9.1 This Agreement shall be goveed by and construed in accordance with the laws of Singapore, without regard to choice of law principles. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore Inteational Arbitration Centre in accordance with the Arbitration Rules of the Singapore Inteational Arbitration Centre for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The language of the arbitration shall be English.
10. Other Terms
10.1 This Agreement constitutes the entire agreement of agreed items and other relevant matters between both parties. Other than as stipulated by this Agreement, no other rights are vested in either Party to this Agreement.
10.2 If any provision of this Agreement is rendered void or unenforceable by competent authorities, in whole or in part, for any reason, the remaining provisions of this Agreement shall remain valid and binding.
10.3 The headings within this Agreement have been set for the sake of convenience, and shall be disregarded in the interpretation of this Agreement.
Livdat Law Enforcement Request Policy
Law Enforcement Requests
Livdat will consider the following requests related to users' data:
1. Data Requests. With the exception of Emergency Requests (as described in paragraph 2 below), all requests for user data must be properly served through valid legal process. We will respond to such requests as required by law. Data requests that we will consider include, but are not limited to:
a. a valid subpoena issued in connection with an official criminal investigation is required to compel the disclosure of basic subscriber information, which may include: name, phone number, email address, profile photo, interests, age, gender, hometown, education, occupation, and any recent login/logout IP address(es), if available;
b. a valid court order is required to compel the disclosure of certain records or other information pertaining to the account, not including contents of communications, which may include message headers and IP addresses, in addition to the basic subscriber information identified above;
c. a valid warrant, including a search warrant, issued under applicable criminal and/or civil law procedures upon a showing of probable cause is required to compel the disclosure of the stored contents of any account, which may include messages, photos, videos, comments, and location information;
d. requests issued pursuant to a Mutual Legal Assistance Treaty (“MLAT”) where such requests have been issued in accordance with the prescribed process, as applicable to the relevant MLAT; and
e. requests from any jurisdictions where we have a good-faith belief that a response is required by law in that jurisdiction, the affected users are in that jurisdiction, and the request is consistent with inteationally recognized standards.
2. Emergency Requests. We will respond to requests for user data in situations that we believe in good faith may involve a real and imminent danger of death or serious bodily harm, harm to a minor or other exigent danger as we may determine if we do not respond without delay. If you are not a law enforcement agent and are aware of an emergency situation, please notify your local law enforcement officials. If we choose to make such a disclosure, we will only disclose the user information needed to resolve the emergency. All emergency disclosures must be approved by the Livdat Legal Team whose contact details are set out below.
3. Preservation Requests. We will also consider requests to preserve a user's existing data in connection with official criminal investigations or other official legal proceeding. If we deem the preservation request valid, we will maintain a user's existing data for 30 days or longer period, pending service of a formal data request. The preservation hold may also be further extended as permitted under applicable law.
4. Other Information Requests. We will consider non-law enforcement requests for information including requests from regulatory agencies and tax authorities. Such requests can be made by contacting the Livdat Legal Team at [email protected]
Communications with Users
Livdat 's policy is to notify users of requests for their information prior to disclosure except (i) where providing such notice is prohibited by the valid legal process, court order, or applicable law, (ii) where notice could create a risk of injury or death to an identifiable individual(s), or (iii) cases that involve potential harm to minors. If a data request includes a nondisclosure order, Livdat will notify the affected user as soon as the order is overtued or expires on its own terms.
If a law enforcement official requests information about a user who has provided consent for the official to access or obtain the user’s account information, the user should be directed to obtain that information on their own from their account.
We encourage law enforcement agencies to contact us via email at [email protected] regarding the availability of user information before serving the formal request.
Acceptance of legal process by any of these means is for convenience and does not waive any objections, including lack of jurisdiction or improper service. We are unable to process data requests served via email.
We may provide a certificate of authentication, but we generally are not able to provide in-person or expert witness testimony.
Livdat may seek reimbursement for costs associated with responding to law enforcement requests for information as permitted by law and may charge additional fees for costs incurred in responding to unusual or burdensome requests.
Livdat may collect and store information about users’ usage of and interaction with the Service and our websites.
In accordance with our terms, policies and applicable law, Livdat will provide responsive records to law enforcement inquiries. While may not be applicable in every case, below are the principles that outline the process for cooperation with law enforcement agencies.
Authorized law enforcement may send inquiries using an official govement domain to [email protected] .com. Typically, we require the following from any law enforcement inquiry:
• A clear legal basis for making the request
Information sought and how this specified information may support an investigation. Vague or broad requests that are not beneficial to a particular investigation may not be processed; and
In addition to an email address from a law-enforcement domain, we require the name of the issuing authority, ID number of the agent or officer inquiring and a direct number for the agent or officer responsible.
Without this minimum general information, requests may not be processed and/or may be delayed. We aim to be responsive and to be fully cooperative with all request in accordance with our terms, policies and legal process in all instances.
